OVERVIEW OF THE POSITION

The Somali Provisional Constitution adopted in 2012 provides an interim legal framework for Somalia’s federalism, which also sets principles for the establishment of police organisations both at federal and state levels. Based on this provision, political agreements have been reached among the Somali leadership, developing more details on the federated policing model in Somalia.

In 2016, the National Leadership Forum adopted the New Policing Model, which is a Somalia owned and led police reform initiative, focusing on the development of a federated policing system that contains federal and state level components. The New Policing Model was consequently consolidated by the Somali National Security Architecture in April 2017 and the Security Pact for Somalia during the London Conference in May 2017.

The National Security Architecture was integrated into the Security Pact. The Security Pact contains a plan for security sector reform as part of a comprehensive approach to advance sustainable security, for which the international community intends to continue to provide sustainable support. A political agreement between the Federal Government of Somalia (FGS) and Federal Member States (FMSs) on the national security architecture including commitments from partners to support the security sector milestones, are based on an agreement that AMISOM remains critical to securing Somalia’s security and that the transition from AMISOM to Somali security services will be conditions based. The key milestone in the Security Pact is that by 2027 rule of law and security provision across Somalia will be led by the police. Our client continues to support the FGS and the FMS in establishing Technical Committees at the FGS and the FMS level to implement the New Policing Model.

Though the political agreements have given more clarification on Somalia’s policing model, the legitimacy and accountability of the police services still depend on specific police legislation at both federal and state levels. In this regard, the services of two legal consultants (one international and one national) are required as part of the support to the existing Technical Committees in developing a draft Federal Police Act template and a draft State Police Act template. The consultants will communicate with national stakeholders on a federated police legal framework during multiple Technical Committee meetings in Mogadishu and in the capital cities of the FMS.

The international consultant will work closely with the Police Section and will be based in the Police Section. Transportation from Mogadishu to the Federal Member States and return will be facilitated as required.

GENERAL FUNCTIONS

Role objective:

1) Provides advice to our client's Police Commissioner on police legislative issues.

2) Provides advice to FGS Ministry of Internal Security and FMS Ministry of Internal Security or Ministry of Interior on police legislative issues based on the New Policing Model.

3) Carries out legislative reviews and other extensive legal research and analysis including preparing legal opinions, studies, reports and correspondences.

4) Evaluates current Somali legislation, decrees, codes and other instruments related to the police act.

5) Collaborates as required with our client’s legal and human rights personnel as well as liaising with national judicial, prosecutorial and parliamentary authorities on a federated police legislation.

6) Produce a draft Somali Federal Police Act template and a draft State Police Act template.

7) Undertake other appropriate duties as may be specified by our client’s Police Commissioner.

Expected output:

1) Develop a ‘roadmap’ in consultation with the Somali Government counterparts that outlines a process for enacting a new Police Act.

2) Production of a draft Somali Federal Police Act template and a draft State Police Act template

Project reporting:

The International Legal Consultant will report to our client's Police Commissioner or his delegate.

Team management:

This role does not require team management

ESSENTIAL EXPERIENCE

Education:

Master's degree in An advanced university degree (LL.M, LL.D or equivalent) in law is required, preferably with an emphasis in Administrative Law. and/or Bachelor's degree in A first level university degree in combination with two additional years of specific training in administrative law, a relevant combination of academic qualifications and/or legal experience may be accepted in lieu of the advanced university degree.

Work experience:

Minimum of 7 years of demonstrable relevant Law experience.

Geographical experience:

Minimum of 3 years of experience in Africa with local experience in Mogadishu is an advantage.

Languages:

Fluency in Somali (desirable) and English (essential).

Key competencies:

  • A minimum of seven years of progressively responsible legal experience, including experience in drafting laws, policies and procedures related to policing or law enforcement is required.
  • Experience in the use of modern Internet-based research methodologies and sources is required.
  • Experience as a legal adviser in a national law enforcement agency or in Peacekeeping or other international experience is also desirable.
